This Privacy Policy applies to our websites, mobile applications, products, features, and services operated under the Gayte App brand ("Gayte", "we", "us", or "our") by GAYTE LLC, collectively referred to as the "Service".
This Privacy Policy explains how we collect, use, store, protect, disclose, and share information about you and describes your privacy rights and choices. It also explains how we use age-assurance technologies, including facial age estimation, liveness detection, and, where necessary, identity-document verification.
By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Privacy Policy or our Terms of Service, you should not access or use the Service. Where applicable law requires consent or another affirmative authorization for a specific processing activity, we will request it separately.

You are not required to provide every type of information listed above. However, some information may be necessary to create or maintain an account, use certain features, complete age assurance, process purchases, provide support, maintain safety, or comply with applicable law.
Some information you choose to provide may be considered sensitive personal data or a special category of personal data under applicable law. This may include information relating to racial or ethnic origin, health, HIV status, sex life, sexual orientation, gender identity, preferred pronouns, relationships, preferences, or other intimate information.
Providing profile-related sensitive information is voluntary unless a particular feature clearly requires it. Where consent is the applicable legal basis, you explicitly consent to Gayte processing the information you choose to provide for the purposes described in this Privacy Policy, including operating the Service, displaying information according to your settings, enabling discovery and interaction, providing relevant features, and maintaining safety and security.
Depending on the technology used and applicable law, facial images, liveness captures, facial characteristics, facial geometry, templates, embeddings, and related derived signals used for age assurance may be treated as biometric data, sensitive personal data, or special category personal data. Where a separate notice, explicit consent, written release, or other authorization is required, Gayte will provide the required notice and request the applicable authorization before the relevant data is collected or processed.
You may withdraw consent at any time where processing is based on consent. Withdrawal does not affect processing that was lawful before withdrawal and may affect the availability of certain features. Withdrawal does not require Gayte to grant access to an adults-only Service without completing an alternative lawful age check.
If you register, sign in, or connect your Gayte account through a third-party social media service or authentication provider, we may receive information made available by that service, such as your name, email address, profile photo, account identifier, and other information you authorize.
You may be able to disable the connection through your settings with the third-party service. Your use of third-party authentication or social media services is subject to their own terms and privacy policies.
The Service may use approximate or precise location data to provide location-based features, calculate approximate distance, help users discover other users, improve safety and security, prevent fraud or abuse, and operate the Service.
Depending on your settings, device permissions, and the feature used, we may process approximate or precise location data. You may manage location access through your device or Service settings, but some features may be unavailable or may not function properly if location access is disabled.
Location data can reveal sensitive information about your activities, places you visit, or movement patterns. It may also increase risks such as unwanted contact, stalking, harassment, burglary, or physical harm. You are responsible for carefully choosing your location settings and considering the risks of sharing location-related information.
Gayte may automatically collect and process technical and usage information when you access or use the Service, including when you visit our website without logging in. This may include your IP address, device identifiers, advertising identifiers, browser type, operating system, app version, device type, display resolution, language settings, access times, pages viewed, features used, interactions, crash data, log data, and other technical information.
We use this information to operate, secure, maintain, analyze, customize, troubleshoot, and improve the Service and to prevent fraud, abuse, spam, security incidents, and misuse.
We use Cloudflare Turnstile to distinguish between human users and automated bots and to protect the Service against spam, abuse, fraud, and automated misuse. Cloudflare Turnstile may process technical signals such as IP address, TLS fingerprint, User-Agent string, site key, associated origin, and related security information.
Cloudflare may act as our processor or service provider for these security functions and may process limited information as an independent controller where permitted under its own privacy terms.
We use Zoho Desk, provided by Zoho Corporation, to process and manage contact, complaint, appeal, and support requests. Zoho Desk may process your name, email address, account information, technical information, attachments, and the content of your request to provide support services on our behalf.
Depending on location and configuration, this information may be hosted in the European Union or other jurisdictions. Restricted international transfers are made using appropriate safeguards where required by law.
Gayte may request additional information where reasonably necessary to verify account or profile information, complete an age or identity check, investigate suspected fraud, abuse, or misuse, provide support, respond to an appeal, comply with legal obligations, enforce our Terms, or protect the safety, security, and integrity of the Service.
Gayte is an adults-only Service. To enforce the minimum age requirement, help prevent minors from accessing the Service, protect users, prevent fraud or misuse, and comply with legal, regulatory, app-store, or platform requirements, we may require you to complete an age-assurance process before creating an account, accessing certain features, or continuing to use the Service.
We use Didit, a third-party age-assurance and verification provider, to perform certain checks on our behalf. The relevant Didit entity and authorized subprocessors may vary according to Gayte's contract, the verification workflow, and the location of processing. Didit generally acts as Gayte's processor or service provider for checks configured by Gayte. Didit may process limited information as an independent controller for purposes such as security, abuse prevention, audit logging, legal compliance, dispute resolution, and legal claims, as described in its privacy notices.

The data processed may include a selfie or facial image, facial characteristics and derived signals, an estimated age, age-threshold result, liveness and anti-spoofing results, confidence or quality indicators, verification status, warnings, timestamps, session identifiers, IP address, device and browser information, network-derived location, and related security or fraud-prevention information.
Gayte configures the service to receive and retain only information reasonably necessary for the age gate, security, fraud prevention, appeals, and legal compliance. Gayte does not use an estimated age as the age shown on your profile. Gayte does not use age-assurance data for advertising, cross-context behavioral advertising, or unrelated profiling. Gayte does not use your age-assurance data to train its own artificial-intelligence models.
Where supported by the selected workflow, Gayte disables supplementary demographic outputs that are not needed for age assurance, including gender-estimation output. Gayte does not create or maintain a face-search or face-index database for identifying users across accounts or services.
If facial age estimation is inconclusive, indicates that you may not meet the minimum age requirement, or raises a security concern, you may be asked to try again or use another method. In some cases, you may be asked to use an official identity document. Document verification may involve the document image, document type, issuing country, date of birth, authenticity results, and a comparison between the document photograph and the person completing the check.
Age estimation is probabilistic. It may not represent your exact chronological age and is not legal proof of age. A successful age check does not verify your full legal identity, background, conduct, profile information, intentions, or trustworthiness.
Your age-assurance selfie, estimated age, identity document, liveness score, and verification records are not displayed on your public profile and are not visible to other users.
Cookies are small text files stored on your device when you visit a website or use an online service. Cookies and similar technologies can recognize a device, remember preferences, keep you signed in, improve functionality, analyze usage, prevent fraud, and support advertising or measurement.

You can manage cookies through your browser settings and, where available, our consent tools. Disabling essential cookies may affect functionality or prevent certain features from working.
We may not respond to "Do Not Track" signals or similar browser mechanisms except where required by law. Where legally required, we recognize or provide mechanisms for applicable opt-out preference signals.
Your device or operating system may allow you to limit advertising identifiers, disable personalized advertising, restrict tracking, and manage permissions such as location, camera, microphone, photos, and notifications. Disabling permissions may affect the Service.

We process personal data where necessary to create and manage your account, provide requested features, process subscriptions or purchases, provide support, communicate about the Service, and enforce the adults-only eligibility rule that forms part of our Terms.
We rely on consent where required, including for optional sensitive profile information, precise location where consent is required, certain marketing, non-essential cookies, advertising technologies, and specific age-assurance or biometric processing that legally requires consent, explicit consent, a written release, or another affirmative authorization.
Where a separate authorization is required, acceptance of this Privacy Policy alone is not intended to replace it. We will request the authorization through a separate affirmative action before the relevant data is collected or processed.
We may process personal data where necessary for legitimate interests such as operating and securing an adults-only service; preventing minors from accessing it; preventing fraud, abuse, spam, and misuse; enforcing our Terms; protecting users; improving the Service; and maintaining security, integrity, and reputation, provided that these interests are not overridden by your rights and freedoms.
We process personal data where necessary to comply with applicable laws, regulations, court orders, lawful requests, accounting, tax, consumer-protection, data-protection, online-safety, biometric-privacy, and regulatory obligations.
We may process personal data where necessary to establish, exercise, or defend legal claims; protect the vital interests of a person; or meet an applicable substantial-public-interest condition.
The specific basis for age assurance depends on location, the method used, and the reason the check is required. If you do not provide information required to complete an age check, Gayte may be unable to provide access to the Service. An alternative method or review may be offered where appropriate or required by law.
Gayte uses personal data to enable account creation, profiles, communications, user discovery, requested features, support, purchases, safety, and operation of the Service.
We may use your contact details for service-related messages and, where permitted, marketing. You may opt out of marketing, but you may still receive administrative, security, transactional, or legal notices.
Information you choose to make visible may be displayed to other users through profiles, discovery, search results, or related features. Messages and media are shared according to your actions and the functionality of the Service.
Gayte and Didit may use automated systems, including artificial intelligence and machine-learning models, to estimate age, assess liveness, detect spoofing or manipulation, generate confidence or quality indicators, and produce an approval, decline, warning, resubmission, or review result.
The principal logic is to analyze facial characteristics in a submitted selfie and produce a model-predicted age or age-related result. A passive liveness process assesses whether the capture appears to show a real person rather than a photograph, screen, mask, synthetic image, or other presentation attack. Where document verification is used, automated systems may assess document authenticity and compare the person completing the check with the document photograph.
Gayte may use the result to allow or deny account creation or access, require a retry, request another verification method, route a case for review, suspend an account, or enforce the minimum-age requirement. Because age estimation is probabilistic, results may be inaccurate or inconclusive, especially near the age threshold or where lighting, image quality, technical conditions, accessibility needs, or other factors affect the analysis.
If you believe a result is incorrect, you may request a retry, an available alternative verification method, or review by submitting a support request through https://gayteapp.com with "Age Verification Appeal" in the subject or description. Where applicable law provides additional rights concerning automated decisions, including human intervention or the right to express your point of view, Gayte will honor those rights.
Gayte does not sell personal data. Gayte does not sell, lease, trade, or otherwise profit from age-assurance or biometric information. We do not disclose age-assurance data for targeted advertising or cross-context behavioral advertising.

Didit generally processes verification data as Gayte's processor or service provider for the workflow requested by Gayte. Didit may process limited data as an independent controller for security, abuse prevention, legal compliance, audit, dispute resolution, and legal claims under its applicable notices.

Where payment is processed by an app store or payment provider, Gayte generally does not receive full card numbers or bank-account details.
Gayte may use aggregated, anonymized, or de-identified information for analytics, reporting, research, security, or service improvement where the information cannot reasonably identify you. Age-assurance data is not used for unrelated model training by Gayte.
Gayte is operated by GAYTE LLC, and personal data may be processed in the United States, the European Economic Area, the United Kingdom, Switzerland, and other jurisdictions where Gayte or its service providers operate.
The relevant Didit entity and authorized subprocessors may vary according to Gayte's contract and the location of processing. Didit and its authorized subprocessors may process information in the European Union, the United States, or other jurisdictions described in the applicable privacy notice and contractual documentation.
Where a restricted transfer occurs, Gayte uses safeguards required by applicable law, which may include adequacy decisions, Standard Contractual Clauses, the UK International Data Transfer Addendum, data-processing agreements, transfer assessments, and technical and organizational measures. You may contact us for additional information about relevant safeguards.
Gayte implements technical and organizational measures designed to protect personal data against unauthorized access, loss, misuse, alteration, disclosure, or destruction. Measures may include encryption in transit, access controls, authentication, logging, monitoring, secure infrastructure, restricted access, vendor controls, and other safeguards appropriate to the data and risk.
Age-assurance and biometric information, where processed, is handled using protections appropriate to sensitive information. Gayte requires service providers to use reasonable safeguards and limits access to personnel and providers with a need to process the information.
You are responsible for the security of your login credentials, account, and device. No system or method of transmission or storage is completely secure, and Gayte cannot guarantee absolute security.
The Service may contain links, integrations, advertisements, or services provided by third parties. Gayte does not control and is not responsible for third-party privacy practices, content, security, policies, or operations, except to the extent Gayte is responsible under applicable law for a provider acting on our behalf.
Different terms and privacy policies may apply when you independently use third-party websites, applications, or services. Review those policies before providing personal data.
This Privacy Policy applies to personal data processed by Gayte in connection with the Service. It does not govern personal data processed independently by another user or an unrelated third party.

We may need to verify your identity before responding. We will respond within the period required by law. We may retain or withhold information where required or permitted for legal obligations, security, fraud prevention, accounting, dispute resolution, safety, compliance, or the rights of others.
Residents of certain US states may have additional rights under applicable state privacy or biometric-privacy laws. Gayte will provide any required notice, consent mechanism, or appeal process based on the user's jurisdiction and the data processed.
You may be able to view, edit, update, or delete certain personal data through your account settings. You are responsible for keeping account information accurate and current.
You may contact Gayte to request access, correction, deletion, restriction, portability, objection, or information about age assurance. If you delete your account, certain data may be retained where required or permitted for legal obligations, accounting, fraud prevention, security, safety, disputes, enforcement, or protection of users and third parties.
All retained personal data remains subject to this Privacy Policy.
You can delete your account through the app where the feature is available. Gayte may delete Standard accounts inactive for more than 180 days. This inactivity rule does not apply to Premium accounts with active paid subscriptions.
After account deletion, personal data may remain in backups for up to 30 days before deletion or overwriting, except where a longer period is required or permitted for legal obligations, security, fraud prevention, legal claims, accounting, compliance, or disputes.

Gayte follows a data-minimization approach for age assurance. The retention schedule below applies unless a shorter period is required by law or a longer period is strictly necessary for an active security investigation, complaint, dispute, court order, or legal claim:

Gayte may instruct Didit to delete an individual verification session earlier. Where a user exercises a valid deletion right, Gayte will delete or instruct deletion of eligible data, subject to lawful exceptions. Gayte will not keep biometric identifiers or biometric information beyond the time required to satisfy the initial purpose or beyond any shorter statutory destruction deadline.
Gayte does not authorize Didit to use Gayte user verification data for unrelated advertising or for training general-purpose models. Any provider use for service security, validation, or improvement must comply with the applicable contract, privacy notice, opt-out settings, and law.
To maintain server performance and efficient operation, Gayte may automatically delete, limit, or make unavailable media and audio exchanged in private conversations according to account type and technical limits.
Unless otherwise stated, content may be deleted after 24 hours for Standard accounts and one-day Premium passes, after 30 days for monthly Premium subscriptions, and after up to 12 months for annual Premium subscriptions. These are maximum periods and do not guarantee availability for the full period.
Upon renewal, a new retention cycle begins and content from the previous cycle may be deleted. Renewal does not extend, accumulate, or preserve content from prior cycles. Upon cancellation, expiry, suspension, or termination, the account becomes subject to the Standard policy. Deletion may be permanent and occur without prior notice except where law requires otherwise.
The Service is intended exclusively for users who are at least 18 years old or the age of majority in their jurisdiction, whichever is greater. Gayte does not knowingly permit persons below the applicable minimum age to create or maintain an account or use the Service.
Because age assurance is used to determine eligibility, Gayte and its providers may temporarily process limited personal data from a person whose age has not yet been confirmed, including a person who is later determined or reasonably suspected to be below the required age. This may include a selfie, age-estimation result, liveness or anti-spoofing information, technical information, security signals, and, where necessary, identity-document information.
This limited processing is carried out only to assess eligibility, prevent underage access, protect users, prevent fraud or misuse, meet legal obligations, and maintain appropriate security or audit records. It does not mean that Gayte authorizes minors to use the Service.
If a person does not meet the applicable age requirement, Gayte may prevent account creation, restrict or terminate access, delete the account, and delete or instruct providers to delete associated personal data, except where limited retention is required or permitted for security, fraud prevention, complaints, legal compliance, disputes, or legal claims.

Gayte may update this Privacy Policy from time to time. We will publish the updated version through the Service or by other reasonable means. Where required or appropriate, we may provide notice of material changes through the Service, by email, or by another reasonable method.
We encourage you to review this Privacy Policy periodically. Continued use after an updated policy becomes effective means that you acknowledge the updated policy, except where law requires a different form of notice or consent.
